EOSOL New Energy
We advised EOSOL New Energy from the beginning to the start-up of the development of a 250MW photovoltaic project (Tocopilla), located in the north of Chile. The advice consisted of a strategic issue: identifying the layout of the project, with the objective to recognize the necessary permits to then obtain all the environmental and sectorial permits, land, easement, and mining rights, and, also, in the operation of mergers and acquisitions of the project.
Pfizer Inc
We advised Pfizer Inc. regarding the processing of its employees’ personal data in Chile, in the context of a joint venture with another relevant actor in the pharmaceutial market.
Concessionaire Company
We are representing a concessionaire company before the arbitration commission established in a concession contract, regarding a lawsuit aimed at adapting the contractual conditions, so as to distribute the decrease in revenues produced by COVID-19, which has been estimated at several hundred million dollars.
Concessionaire Company
We successfully represented a concessionaire company in an arbitration for an amount of USD 230 million, with a major international construction company, which incurred in serious breaches of the EPC contract that compelled it to build the concessioned works for the benefit of our client.
Mining Company
We are representing one of the largest copper mining companies in the world in an arbitration suit related to the execution of an EPC contract for the expansion of our client's refining plant.

We advised a major Chilean public university in a dispute with a recognized international construction company, regarding a contract for approximately USD 56 million for the construction of a university campus located in downtown Santiago.

We conducted a constitutional brief before the Constitutional Court. In a $1.2 billion partition trial of a mining family office, the parties challenged a civil procedural statute that was critical to resolving the case. The petition was filed with the Constitutional Court and an expert opinion was required to support and uphold the petition.

Official committee of Unsecured Creditors (UCC) of LATAM Airlines Group S.A.
Constitutional Counsel to the United States Bankruptcy Court for the Southern District of New York in Chapter 11, LATAM Airlines Group S.A., Case No. 20-11254. The advice was requested by UCC, inquiring whether the reorganization program that was the subject of a negotiation was feasible to be implemented in Chile, according to the Chilean Public Order Law.

We advised Ecora Resources PLC (formerly Anglo Pacific Group PLC) on the postponement of a mortgage established by Mantos Copper S.A. in favour of Southern Cross Royalties Limited; in favour of a new mortgage established by Mantos Copper S.A. in favour of Canadian Imperial Bank of Commerce, as local collateral agent.
KGHM
We advised KGHM in obtaining legal reports on different aspects of its legal activities, such as environmental, water, mining and constitutional law. Likewise, in the environmental proceedings to obtain environmental permits for the realization of 400 exploration platforms in the north of Chile, for the development of the Carrizalillo Mining Project.
Rio Tinto
We advised Rio Tinto in the negotiation for the issuance of a permit to explore on military lands, which has been denied for the past fourteen years for all national and international mining companies (including BHP and Anglo American).
Sociedad Concesionaria Metropolitana de Salud S.A. (“SCMS”)
Obtaining an innovative ruling on liquidation proceedings (bankruptcy). SCMS requested the forced liquidation of Inversiones Leivi SpA for debts that it has with SCMS, a liquidation request that was finally granted by the Court and is being executed.

Advised the Official Unsecured Creditors Committee (UCC) on different arguments that took place before the Chapter 11 court, mainly related to effects in Chile of certain aspects of the plan proposed by the Company.

Advice to Falabella S.A., in the registration process of six indentures for a total amount of up to UF 30,000,000 (approximately US 1,280,000,000) in the Securities Registry of the CMF, and in the issuance and placement of Series AK Bonds for a total amount of UF 5,000,000 (approximately US 213,000,000).
