Morales & Besa advises Ferrovial Servicios de Salud Sociedad Limitada in Administrative claim

Ferrovial was awarded the concession for the construction and operation of the Sotero del Rio Public Hospital. However, the government annulled the concession. Morales & Besa represented Ferrovial in its administrative claim before the Comptroller General (Contraloría General de la República), where we argued that the annulment is illegal. The Comptroller ruled that the government’s annulment of the concession award was illegal. This was the first time that the Chilean Government revoked a decree awarding a concession and also the first time that the Comptroller General has annulled such a decree. Needless to say that the outcome of this procedure will weigh heavily on the future of the Chilean concession model.
