Morales & Besa represented Parex Chile in an environmental claim filed against an Environmental Qualification Resolution (“RCA”)

Morales & Besa successfully represented Parex Chile Limitada in an environmental claim filed against an Environmental Qualification Resolution (“RCA”) issued by the Environmental Assessment Commission of the Metropolitan Region that favorably qualified the project “Planta Productiva Parex”. This RCA established additional requirements on the emissions compensation program of nitrogen oxides (“NOx”). The environmental claim sought to eliminate this additional requirements on the compensation program because they are not applicable in accordance with the project’s emissions.

On February 14, 2018, the Environmental Assessment Service accepted the claim eliminating the obligation to compensate the emissions of nitrogen oxides (“NOx”). By means of the environmental claim we were able to reverse the criterion of the Environmental Assessment Service, without bringing a suit before the Environmental Courts. The removal of the obligation to compensate NOx’ emissions ensures the project viability.
