Faced with the undeniable reality that the areas in which the State regulates the activities of individuals are growing, Morales & Besa increasingly advises clients on their relationship with State entities.

Our public law advice covers administrative law, state contracting, administrative claims, and regulatory processes. The advice we give seeks to prevent risks, or to achieve the resolution of disputes with the Administration.

In the administrative sanctioning field, we defend the interests of our clients where either a egal breach, or a non-compliant behavior regarding the requirements of a regulated activity are asserted.

We present a defense before all kinds of public bodies, in proceedings where fines or other penalties for alleged infractions are being pursued.

We are accustomed to representing clients before organizations such as the Comptroller of the Republic, the Court of Public Procurement, the Financial Analysis Unit, and Superintendencies.

Official committee of Unsecured Creditors (UCC) of LATAM Airlines Group S.A.
Constitutional Counsel to the United States Bankruptcy Court for the Southern District of New York in Chapter 11, LATAM Airlines Group S.A., Case No. 20-11254. The advice was requested by UCC, inquiring whether the reorganization program that was the subject of a negotiation was feasible to be implemented in Chile, according to the Chilean Public Order Law.
KGHM
We advised KGHM in obtaining legal reports on different aspects of its legal activities, such as environmental, water, mining and constitutional law. Likewise, in the environmental proceedings to obtain environmental permits for the realization of 400 exploration platforms in the north of Chile, for the development of the Carrizalillo Mining Project.
Coz & Blavi
We conducted a constitutional brief before the Constitutional Court. In a $1.2 billion partition trial of a mining family office, the parties challenged a civil procedural statute that was critical to resolving the case. The petition was filed with the Constitutional Court and an expert opinion was required to support and uphold the petition.
Acciona Concesiones and Cobra Infraestructura
Advised the joint venture formed by Acciona Concesiones and Cobra Infraestructura in the evaluation of its participation in the public bidding process called by the National Electricity Coordinator for the awarding of the exploitation rights of the new works established by Exempt Decree No. 229/2021 and the construction rights of the expansion works established by Exempt Decree No. 185/2021, both of the Ministry of Energy of Chile.
